1. General Provisions
1.1. These Terms of Use ("Agreement") govern the use of the video chat service available on gayporn.com ("Platform", "Service", "we", "us").
1.2. ATTENTION: THE SERVICE IS INTENDED EXCLUSIVELY FOR ADULTS (18+). By using the Service, you confirm that you have reached the age of 18.
1.3. By clicking "Agree", "Continue", creating an account, or using the Service in any way, you enter into a legally binding agreement. If you do not agree — immediately leave the Service.

2.4. The Service is intended exclusively for personal, non-commercial use.
3. Age Restrictions and Verification
3.1. Minimum age: 18 years. If the age of majority in your country is higher — that age applies.
3.2. By using the Service, you confirm and warrant that:
- You are 18 years of age or older
- Using such services is legal in your country
- You are not in a jurisdiction where such services are prohibited
3.3. Age verification. In jurisdictions where legislation requires age verification for access to 18+ services, we conduct verification in accordance with the requirements of those laws.
3.4. Refusal to verify (where legally required) or providing false information results in access blocking.
3.5. PRESENCE OF MINORS IS STRICTLY PROHIBITED. Any appearance of persons under 18 years of age on camera or in chat results in:
- Immediate account blocking
- Preservation of evidence
- Notification of law enforcement and child protection organizations (NCMEC, IWF, etc.)
4. Registration and Account
4.1. Registration is required to use the Service.
4.2. Upon registration, you agree to:
- Provide accurate information
- Use a valid email address
- Create a secure password
- Not create multiple accounts
- Not share access with third parties
4.3. You are fully responsible for:
- Security of your credentials
- All actions performed under your account
- Consequences of unauthorized access if it occurred due to your fault
4.4. If you suspect your account has been compromised — notify us immediately.
5. Usage Rules
5.1. Allowed:
- Communication between adults on any topics
- Adult content (18+) by mutual consent of participants
- Voluntary exchange of contacts (at your own risk)
5.2. Strictly prohibited:
Content and behavior
- Any content involving or depicting minors (CSAM)
- Violence, torture, self-harm
- Threats, blackmail, stalking, harassment
- Hate speech, discrimination
- Content related to terrorism
- Suicide, self-injury
Fraud and abuse
- Deception, fraud, extortion
- Impersonation
- Phishing, data harvesting
- Spam, bulk messages, advertising
- Promotion of goods/services without permission
Technical violations
- Recording chats without consent of all participants
- Distribution of chat recordings
- Use of bots, automation
- Hacking attempts, bypassing protection
- Distribution of malware
- Using VPN to bypass blocks
Commercial use
- Using the Platform to provide paid services
- Reselling account access
- Working as a webcam model through our platform
5.3. Consequences of violations:
- Warning (for minor violations)
- Temporary suspension
- Permanent ban without refund
- Law enforcement notification (for serious violations)
6. Child Protection (CSAM Policy)
6.1. We maintain a zero-tolerance policy toward Child Sexual Abuse Material (CSAM).
6.2. Upon detection or suspicion of CSAM, we are required to:
- Immediately block the account
- Preserve all available evidence
- Report to NCMEC (National Center for Missing & Exploited Children)
- Report to IWF (Internet Watch Foundation) for European jurisdictions
- Cooperate with law enforcement agencies
6.3. If you discover CSAM or suspicious content — report immediately through the reporting system or to [EMAIL].
6.4. False CSAM accusations are also a violation.
7. Pricing and Payment
7.1. Beta Period
- During the beta period, the Service is provided free of charge
- You are not obligated to upgrade to a paid version
7.2. Paid Subscription (after beta period)
- Cost: $5 per month
- Subscription renews automatically
- Charge occurs on the renewal date
7.3. Payment
- Payments are processed by a third-party payment provider
- We do not store your credit card data
7.4. Subscription Cancellation
- Can be cancelled at any time in account settings
- After cancellation, access remains until the end of the paid period
- No new charges are made
7.5. Chargebacks
- Unjustified chargebacks result in account suspension pending investigation
- Systematic chargebacks — permanent ban
- We reserve the right to dispute chargebacks
8. Refund Policy
8.1. Refunds are not available if:
- More than 14 days have passed
- You have used the Service (entered chats)
- Account is blocked for violations
9. Privacy and Data
9.1. What we DO NOT record:
- Video stream
- Audio stream
9.2. What we may store:
- Text messages (temporarily, for complaint processing)
- Connection logs (IP, time, duration)
- Account data (email, registration date)
9.3. When we review data:
- Upon receipt of a complaint
- Upon suspicion of violations
- At the request of law enforcement

10. Disclaimer of Warranties
10.1. The Service is provided "as is" without any warranties, express or implied.
10.2. We are not responsible for:
- Content created by Users
- Behavior of other Users
- Interactions between Users (online and offline)
- Accuracy of information provided by Users
- Technical failures, service interruptions
- Data loss
- Any direct or indirect damages
10.3. You understand and accept that:
- We do not moderate chats in real-time
- You may encounter unacceptable content
- You decide who to communicate with
- You use the Service at your own risk
10.4. If your chat partner's behavior concerns you — immediately end the chat and file a report.
11. Your Obligations and Indemnification
11.1. You agree to:
- Comply with this Agreement
- Comply with applicable law
- Respect the rights of other Users
- Report violations
11.2. Indemnification. You agree to defend, indemnify, and hold harmless us, our partners, employees, and agents from any losses, claims, expenses (including legal fees) arising from:
- Your violation of the Agreement
- Your violation of third-party rights
- Your content
- Your use of the Service
12. Intellectual Property
12.1. Our property. The Platform, its design, code, functionality, trademarks — are our exclusive property.
12.2. Your content. Content you create in chats belongs to you. We do not claim rights to user content.
12.3. Limited license. We grant you a limited, non-exclusive, revocable license to use the Service in accordance with the Agreement.
12.4. Prohibited:
- Copying, modifying the Platform
- Reverse engineering
- Creating derivative works
- Using our trademarks
13. Termination of Access
13.1. Blocking by us
We may block your account:
- For violating the Agreement
- Upon suspicion of fraud
- Upon receipt of justified complaints
- At the request of law enforcement
- At our sole discretion
13.2. Account deletion by you
- You can delete your account in settings
- After deletion, data is removed in accordance with the Privacy Policy
- Active subscriptions are not cancelled automatically — cancel them separately
13.3. Consequences of termination
- Service access is terminated
- If blocked for violations — no refunds are issued
- Provisions on privacy, indemnification, and limitation of liability remain in effect
14. Limitation of Liability
14.1. To the maximum extent permitted by applicable law:
14.2. Our aggregate liability for any claims is limited to the amount you paid for the last 3 months of Service use.
14.3. We are not liable for:
- Indirect, incidental, punitive damages
- Lost profits
- Data loss
- Emotional distress
14.4. Some jurisdictions do not allow limitation of liability. In such cases, limitations apply to the maximum extent permitted.
15. Dispute Resolution
15.1. In case of a dispute, the parties make efforts to resolve it through negotiation.
15.2. Pre-claim procedure: before going to court or arbitration, you must send us a written claim to [EMAIL]. Review period — 30 days.
15.3. You agree that any disputes will be resolved individually. You waive participation in class action lawsuits.

16. Final Provisions
16.1. Severability. Invalidity of individual provisions does not affect the validity of others.
16.2. Waiver of rights. Our non-enforcement of any provision does not mean waiver of the right to enforce it in the future.
16.3. Entire agreement. This Agreement (including the Privacy Policy) constitutes the entire agreement between you and us.
16.4. Assignment. You may not transfer your rights under the Agreement. We may transfer our rights without your consent.
16.5. Language. In case of discrepancies between versions, the English version takes precedence.
